27.05.2022, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
WP(C) NO. 17212 OF 2022 ..2..
JUDGMENT
The petitioner is aggrieved by Ext.P1 notice issued by the 3rd respondent, directing the petitioner to demolish certain alleged constructions carried out by the petitioner in her residential building. The petitioner contends that Ext.P1 order has been issued without hearing the petitioner.
2. When the matter came up for consideration today, the learned Standing Counsel for the Municipality on instructions submits that, Ext.P1 is only a notice and further steps under Section 406(1) of the Kerala Municipality Act, 1994 will be issued to the petitioner pursuant to Ext.P1 and that only after complying with the provisions under Section 406 of the Act, further coercive steps will be taken against the petitioner.
In the light of the said submission, the writ petition is disposed of.
