JUDGMENT
The original petition is filed, interalia, to direct the Court of the Munsiff, Muvattupuzha to consider and dispose of O.S.No.597/2019, within a time frame.
2. Pursuant to the order dated 06.05.2022 passed by this Court, the learned Munsiff has by communication dated 24.05.2022 informed this Court that the suit is filed for partition. The defendants in the suit are set ex-parte. The suit was posted for pre-trial steps to 25.05.2022 and can be disposed of within 20 days.
3. Heard; Sri.K.I.Sageer, the learned counsel appearing for the petitioner. In view of the limited relief that I propose to pass, I dispense with notice to the respondents.
In the light of the pleadings and the materials on record and the communication of the learned Munsiff OP(C) NO. 804 OF 2022 4 and in exercise of the powers of this Court under Article 227 of the Constitution of India, I direct the Court of the Munsiff, Muvattupuzha to consider and dispose of O.S.No.597/2019, in accordance with law, as expeditiously as possible and at any rate on or before 30.06.2022. Needless to mention, the disposal of the suit will be without prejudice to the right of the respondents to seek for setting aside of the ex-parte decree.
The original petition is ordered accordingly.
