 WP(C) NO. 6985 OF 2022

                                       3

                                    JUDGMENT

The petitioner states that while he was working as U.P. School Teacher in the Athmavidya Sukumara Vilasam U.P School, Edakkara, he was placed under suspension for 15 days with effect from 24.12.2016 invoking the provisions of Section 12-A of the Kerala Education Act r/w Rule 75 of Chapter XIV-A of the KER. According to the petitioner, being aggrieved by the denial of treating the period of suspension as a duty for all purposes, the petitioner had approached the 2nd respondent. However, the same was rejected. In the said circumstances, he has preferred Exhibit P17 revision petition before the Government, which is stated to be pending. It is in the afore circumstances that this writ petition is filed seeking directions for expeditious consideration of Exhibit P17.

2. I have heard the learned counsel appearing for the petitioner and the learned Government Pleader. In the nature of the order that I propose to pass, notice to the 6th and 7th respondents is dispensed with.

3. After having carefully evaluated the contentions raised in this writ petition, the submissions made across the Bar, and the facts and circumstances, I am of the view that this writ petition can be disposed of by issuing the following directions: WP(C) NO. 6985 OF 2022 4

a) There will be a direction to the 1st respondent to take up, consider and pass appropriate orders on Ext.P17 revision petition after affording an opportunity of being heard, either physically or virtually, to the petitioner herein or his authorised representative and the 6th respondent.

b) Orders, as directed above, shall be passed expeditiously, in any event, within a period of two months from the date of production of a copy of this judgment.

c) It would be open to the petitioner to produce a copy of the writ petition along with the judgment before the concerned respondent for further action.

This writ petition is disposed of.
