                               O R D E R

The petitioners are the accused in Crime No. 1373/2021 of Palakkad police station which was registered for the offenses punishable under section 143, 147, 148, 451, 324, 308, r/w 149 IPC.

2. The prosecution case is that on 13.12.2021 at 3.am, the petitioners are formed themselves into an unlawful assembly and assaulted the respondents 3 to 8 in front of Victoria College gate at Palakkad. Annexure A1 is the FIR. This Crl.M.C is filed for quashing all further proceedings pursuant there of .

3. Heard Sri. Krishnadas. P Nair, Learned Counsel appearing for the petitioners, Sri. Prasanth, Learned Public Prosecutor, Sri. M.A.Vinod Learned Counsel appearing for the respondents 3 to 8.

4. Prayer for quashing the proceedings is sought mainly on the ground that the dispute between the parties has been settled. Annexure-2 affidavits sworn by the respondents 3 to 8 are filed along with this Crl.M.C. to substantiate the settlement. In the said affidavits, the respondents 3-8 had specifically acknowledged the aforesaid settlement and also conveyed the no-objection to quash the proceedings against the CRL.MC NO. 2486 OF 2022 5 petitioners herein. The learned counsel appearing for the respondents 3 to 8 also confirms the same. The learned Public Prosecutor, upon instructions, submitted that the Station House Officer concerned has verified the veracity of the same and found it to be genuine.

5. The allegations would reveal that the dispute is purely private in nature. In such circumstances, by applying the principles laid down by the Honorable Supreme Court in Gian Singh v. State of Punjab and Another [(2012) 10 SCC 303], proceedings can be quashed by invoking the powers of this Court under Section 482 Cr.P.C. This is particularly because, on account of the settlement, no fruitful purpose would be served by allowing the prosecution to continue.

6. It is true that the one of the offenses is under section 308 of IPC. However, it is seen from the records of, the petitioners as well as the injured persons are students and the incident occured in connection with a celebration in the college. On going through the records, it is seen that no serious injuries were sustained to the party respondents, and no criminal antecedents were also reported in respect of the petitioners. In such circumstances, I am inclined to invoke the jurisdiction from this court under section 482 Cr.P.C particularly because, the matter is settled CRL.MC NO. 2486 OF 2022 6 between the parties who are students in the same college.

In the result, this Crl.M.C. is allowed, and Annexure-A2 submitted in crime No.1373 of 2021 of Palakkad North Town Police Station and all further proceedings pursuant there to.
