Application praying that in the circumstances stated therein the
High Court be pleased to grant time in producing the certified copy of
final report in C.C.No.199 of 2015 on the file of Chief Judicial
Magistrate Court, Ernakulam.
This Application coming on for admission upon perusing the
application and upon hearing the arguments of M/s. JAISON JOSEPH(J-573).,
M.N.SANJITH, SATHIAN A.P., R.ANUP and SMITHA C.GOPI, Advocates for the
petitioner and the Public Prosecutor for R1 and R2, the court passed the
following:
ORDER
It is brought to my attention that, the prosecution against the 1st accused, is already quashed by this Court as per Annexure A5 order on the basis of settlement arrived at between the 1st accused and the 3rd respondent / defacto complainant. It is also discernible from the records that, the main allegations are against the 1st accused and the petitioner is the 2nd accused. Thus, taking note of the above aspects, I am of the view that, the proceedings against the petitioner can be kept in abeyance for the time being. In such circumstances, it is ordered that the further proceedings in C.C. No.199/2015 pending before the Chief judicial Magistrate Court, Ernakulam shall stand stayed for a period of two months.
