JUDGMENT
The petitioners in these three cases are persons who are included in the Rank List prepared by the Public Service Commission (PSC), for being appointed to the various sanctioned posts of Lower Division Clerk (LDC) and its equivalent, into the 14 Apex Societies in Kerala.
2. The petitioners allege that in spite of the fact that they are all so included, the Apex Societies are not issuing them appointment orders, but are continuing to fill up the available vacancies through daily wage employment or on contract or such other impermissible methods. They thus pray that Apex Societies be directed to immediately appoint them in the available vacancies, in terms of the Advice Memos to be issued by the PSC.

4. Since the facts involved in these cases are not in dispute, I do not require to deal with them in detail.
5. As I have said above, the petitioners are included in a common Rank List prepared by the PSC, for being appointed to the post of LDCs in the various Apex Societies.
6. The petitioners allege that in spite of the fact that the afore said Societies have sanctioned posts of LDCs in their services, they are refusing to make appointments from this Rank List.
7. Therefore, the pertinent question is whether the Rank List is in force and whether there are sanctioned posts in the various Apex Societies to accommodate the persons therein, including the petitioners.
8. Sri.M.Sasindran - learned Standing Counsel for the CONSUMERFED, submitted that there are no sanctioned posts of LDCs in the service of his client.
9. Sri.Manu Govid - learned Standing Counsel for the WP(C) NO.15630/2020 & Con. Cases 10 KERAFED submitted that the Special Rules with respect to his client has not been yet approved by the Government and therefore, that no posts are available to accommodate the petitioners.
10. Sri.M.A.Asif - learned Standing Counsel for the Kerala State Co-operative Agricultural and Rural Development Bank, submitted that the entry level post in the services of his client is Assistant and therefore, that petitioners cannot aspire to be appointed against the same.
11. Sri.T.P.Pradeep - learned Standing Counsel for the MATSYAFED, submitted that the draft Special Rules relating to his client was initially approved in the year 2016, but that there were various modifications made to it, which was again placed for consideration before the Government, leading to a final concurrence only on 25.02.2020. He submitted that, in the meanwhile, on 13.02.2020, his client has reported all the available vacancies in the post of LDC to the PSC, because under the new Special Rules, the qualifications and criterion for the post in question have been completely altered. 12. As far the learned counsel for the other Apex Societies are concerned, they say that all the sanctioned vacancies available in their services have already been reported to the PSC.
13. It is, therefore, indubitable that there is no contest that the sanctioned and available posts of LDC in all the Apex Societies can only be filled up from the Rank List in question, since it is still in force and will expire only on 25.02.2023. Since most of them have already reported vacancies to the PSC, said Authority must now issue Advise Memos based on the same, so as to enable the petitioners to be appointed in the services of the respective Societies without any further delay.
14. As far as KERAFED is concerned, Sri.Manu Govind - their learned Standing Counsel, says that it has no Special Rules yet and that, therefore, there are no sanctioned posts of LDC, the petitioners cannot seek to be appointed to it, at least until such time as the Special Rules are approved.
15. As far as the CONSUMERFED is concerned, since they say that there are no sanctioned posts of LDC in their services WP(C) NO.15630/2020 & Con. Cases 12 again, the petitioners cannot seek appointment against any other post, unless they are able to approach the competent Authority and ensure that such posts are created or made available.
16. Coming to the afore recorded arguments of Sri.M.A.Asif
- learned Standing Counsel representing Kerala State Co- operative Agricultural and Rural Development Bank, Sri.P.V.Baby - learned counsel for the petitioner in W.P(C)No.15630 of 2020, submits that the post of Attendant is equivalent to the post of LDC and that they are creating a subterfuge to avoid appointment from the Rank List in question. This issue certainly is one that will have to be considered by the competent Authority of the PSC, because it will not be possible for this Court to verify whether the posts are equivalent. I am, therefore, of the view that the PSC must consider these rival contentions and then issue Advice Memos to the eligible candidates.
17. As far as the MATSYAFED is concerned, even though their learned Standing Counsel has made the afore submission, WP(C) NO.15630/2020 & Con. Cases 13 Ext.P8 in W.P(C)No.2918 of 2021 would render it luculent that the Special Rules with relation to their services were approved in the year 2016. It is unambiguously so stated by its General Manager in the said document and I fail to understand how they can take a contrary stand now. In such perspective, when the Rank List came into force after the Special Rules were so approved, the MATSYAFED can only appoint from the Rank List to the sanctioned posts of LDC and in no other manner. Of course, I record the submissions of Sri.P.C.Sasidharan - learned Standing Counsel for the PSC that there are certain NJD vacancies as far as the MATSYAFED is concerned and that his client will deal with the same, if this Court is so inclined, in terms of law.
In the afore circumstances, I order these writ petitions in the following manner:
a) Except in the case of KERAFED and CONSUMERFED, the PSC will forthwith issue Advice Memos to all the candidates in the Rank List, depending upon their placement therein; which shall be done not later than one month from the date of receipt WP(C) NO.15630/2020 & Con. Cases 14 of a copy of this judgment.
b) On such advices being issued, the respective Apex Societies will forthwith appoint the eligible candidates without any delay, but not later than two weeks thereafter.
c) For the purpose of the afore directions to be fructified to its fullest extent, I direct the Apex Societies, except KERAFED and CONSUMERFED, to report all the available vacancies in the post of LDC, as on today to the PSC, within a period of one week from the date receipt of a copy of this judgment.
d) I leave liberty to the petitioners to move the appropriate Authority of the Government with respect to KERAFED and CONSUMERFED for either creation of the posts therein or for concurrence of appointment against the same; and if a representation is made by the petitioners, same shall be considered by such Authority in terms of law, without any avoidable delay, but not later than two months from the date on which such request is made.
e) As regards the Kerala State Co-operative Agricultural and Rural Development Bank, the PSC will hear them, as also WP(C) NO.15630/2020 & Con. Cases 15 the petitioner in WP(C)No.15630 of 2020, and then decide whether the post of "Assistant" in their services is equivalent to the post of LDC under the Kerala Co-operative Societies Rules ('KCS Rules' for short); and if it is so found, it will issue Advice Memos to the candidates, including the petitioners in all these cases, as per their position in the Rank List, within a period of one month from the date of such enquiry being completed. This shall be done dehors any test that may have been conducted by the PSC with respect to the post of Assistant in the afore said Bank, subsequent to coming into force of this Rank List.
(f) Needless to say, in view of the afore directions, any notification issued by the aforementioned Societies to fill up the sanctioned post of LDC or its equivalent post, except from the Rank List until it expires will stand quashed.
