                                  JUDGMENT

The 1st petitioner availed a loan from the respondent bank. Petitioners 2 and 3 are the guarantors of the loan. The bank initiated proceedings under the provisions of the Kerala Co- operative Societies Act and obtained an award against the petitioner. On the basis of the award, revenue recovery proceedings have been initiated against the petitioners.

2. Learned counsel appearing for the petitioners submits that the petitioners are limiting their relief for permission to clear of the liability in reasonable instalments. He submits that the amount due is approximately Rs.5,25,000/-.

Learned Standing Counsel appearing for the respondent bank submits that as on date, the amount due and recoverable from the petitioner is Rs.5,27,366/- (Rupees five lakhs twenty seven thousand three hundred and sixty six only) and that reasonable instalments can be granted to the petitioner to clear the liability.

4. I have heard the learned counsel for the petitioners as well as the learned Standing counsel appearing for the respondent bank.

5. Having regard to the circumstances of the case and WP(C) NO. 25092 OF 2022 3 the situation now prevailing, apart from the submissions made as recorded above, I am of the view that the petitioners can be granted an opportunity to repay the outstanding amount in ten instalments.

Accordingly, there will be a direction to the respondent bank to accept repayment of the entire outstanding amount of Rs.5,27,366/- (Rupees five lakhs twenty seven thousand three hundred and sixty six only) along with accrued interest and bank charges from the petitioners in the following manner:

(i) The outstanding amount of Rs.5,27,366/- (Rupees five lakhs twenty seven thousand three hundred and sixty six only) shall be repaid in ten equated monthly instalments along with any accrued interest/costs;

(ii) The first instalment shall be paid on or before 31.08.2022 and the subsequent instalments shall be paid on or before the last working day of the succeeding months;

(iii) In the event of default of any one instalment, the respondent bank shall be entitled to proceed in accordance with law;

(iv)If the petitioners comply with the aforesaid directions, the revenue recovery proceedings now initiated against the petitioners shall be kept in abeyance. The writ petition is disposed of as above.
