Petitioner is before this Court in this Writ Petition filed under Article 226 and 227 of the Constitution of India seeking a writ of mandamus directing respondent - University to declare the results of the petitioner which has been withheld as stated in Annexure-F dated 05.10.2024 and also to permit the petitioner to appear for the interview.

2. Heard the learned counsel for the petitioner and learned counsel for respondents - University.

In response to the notification at Annexure-A dated 24.03.2023 issued by respondent No.1 - University, the petitioner had applied to the post of Assistant Professor in Agricultural Marketing and Co-operation, against the one post which was reserved for Scheduled Caste category out of two posts which were called for to the aforesaid post. In the list of eligible candidates which was published by the respondents - University, the petitioner's name was found at SL.No.2. However, in the results that were declared after the written examinations were conducted, it was found that the result of the petitioner was withheld for the reason that he had not obtained four years UG and PG degree from Farm University. It is under these circumstances, the petitioner is before this Court.

Learned counsel for the petitioner submits that in the notification at Annexure-A which was issued by -4- NC: 2026:KHC-K:2271 WP No. 202797 of 2024 HC-KAR respondent No.1 - University calling for applications from the eligible candidates to fill up the post of Assistant Professor in Agricultural Marketing Co-operation, no such requirement that the candidate should have passed four years UG and PG degree from the Farm University is found. Petitioner being the only Scheduled Caste category candidate, was entitled to be appointed to the one post reserved for the said category. Only to overcome the same, for extraneous reasons, the respondents have withheld his results as per Annexure-F.

Per contra, learned counsel appearing for the respondents - University, who has filed objections, has placed reliance on a notification dated 18.12.2013 and submits that in the said notification it is specifically stated that for the purpose of recruitment to the post of Assistant Professors in Agricultural University, the candidate should have passed four years UG and PG degree from Farm University.

It is not in dispute that in the notification at Annexure-A dated 24.03.2023 nowhere it is stated that the candidate seeking recruitment to the post of Assistant Professor in Agricultural Marketing Co-operation is required to have completed four years UG and PG degree from a Farm University. The notification dated 18.12.2013 issued by respondent No.1 - University bearing No.AO/RT/ Quali.Asst.Prof./Direct Rectt./2013-14 has not been referred to in the notification at Annexure-A dated 24.03.2023 issued by respondent No.1 - University. Under the circumstances, respondents were not at all justified in issuing Annexure-F stating that the results of the petitioner was withheld for the reason that he had not produced document for having passed four years UG and PG degree course from Farm University. Therefore, the impugned results of the written examination for recruitment of the teaching post in the cadre of Assistant Professor of respondent No.1 - University vide Annexure-F dated 05.10.2024 to the extent it relates to withholding -6- NC: 2026:KHC-K:2271 WP No. 202797 of 2024 HC-KAR the results of the petitioner cannot be sustained. Accordingly, the following:
ORDER
(i) The Writ Petition is partly allowed.
(ii) The impugned result of the written examination for recruitment of teaching staff to the post of Assistant Professor (Kalyana-Karnataka) issued by respondents vide Annexure-F insofar as it relates to withholding the written examination result of the petitioner is quashed.
(iii) The respondents are directed to declare the result of the petitioner in written examination for recruitment to the post of Assistant Professor in Agricultural Marketing Co-operation.
(iv) It appears that on the strength of the interim order passed by this Court, the -7- NC: 2026:KHC-K:2271 WP No. 202797 of 2024 HC-KAR petitioner has attended the interview that was held by the respondents - University and therefore it is needless to state that the respondents shall also announce the result of the said interview along with the result of the written examination forthwith.
