                          ORAL ORDER

This writ petition is filed under Articles 226 and 227 of the Constitution of India seeking the following reliefs:

"A) Issue writ of certiorari quashing the impugned final selection list dated 06.07.2022 passed by respondent No. 1,2 and 4 as per Annexure- G to the extent of Yankanchi Village Tq. Sindagi Dist.

Vijayapura.

B) Issue writ of mandamus directing the respondents No. 1 to 4 to consider the representation Annexure- C, C1 to C3 dated 5.7.2022 and 6.7.2022 and direct the respondents No. 1 to 4 to appoint the petitioner to the post of Anganwadi Assistant of Yankanchi Anganwadi Centre."

2. Heard learned counsel for the parties. -4-

3. Petitioner had filed an application for the post of Anganwadi Assistant of Yankanchi Village, Tq. Sindagi and Dist. Vijayapura, pursuant to notification issued by the respondent No.2 calling for applications to fill up the post of Anganwadi Assistant of Yankanchi Village. It appears that respondent No.5, who had secured higher marks in SSCL examination was selected to the post of Anganwadi Assistant at Yankanchi Village. Being aggrieved by the same, petitioner is before this Court.

Learned counsel for the petitioner submits that candidature of the petitioner, who hails from Yankanchi Village, ought to have been considered for appointment to the post of Anganwadi Assistant at Yankanchi Village, in the place of respondent No.5, since respondent No.5 is not a resident of the said village. He submits that inspite of repeated objections filed by the petitioner, after the provisional list of selected candidates was published, the same was not considered and final list as per Annexure-G was issued.

Per contra, learned counsel for the respondent No.3 submits that after the petitioner submitted her objections to the provisional list, the respondent No.4 had called for a report from the Tahasildar, Sindagi, regarding genuineness of the residential certificate of respondent No.5 and in response to the same Tahasildar had submitted a report that residential certificate issued to respondent No.5 by him was genuine.

Learned Additional Government Advocate has made available to this Court the parawise remarks received in this writ petition from respondent No.4 and also the copy of the meeting proceedings dated 06.07.2022. The final list at Annexure-G has been issued on 06.07.2022, pursuant to the decision of the committee of members, in which the report of the Tahasildar was perused and it was found that respondent No.5 is a resident of Yankanchi Village and resident certificate produced by her was a genuine document. Undisputedly, the petitioner has not questioned the residential certificate -6- NC: 2026:KHC-K:2258 WP No. 201828 of 2022 HC-KAR issued by the Tahasildar to respondent No.5 by filing an appeal before competent authority.

7. Under the circumstances, I do not find any good ground to entertain this writ petition.

8. Accordingly, writ petition is dismissed.
