Learned counsel for the petitioner and the learned counsel for respondent No.2 submit in unison that the dispute between the parties is settled amicably and they have filed the joint memo in that regard which is signed by the petitioner and respondent No.2, along with the affidavit, which reads as under:
"JOINT AFFIDAVIT We. (1) SRI. DR. SRIPATHI RAO, S/O D. Seetharam, Aged 68 year. R/at Near Haradi Mookambika, Gas Agency Plant. Puttur, Kasaba Hobli, Putturu Taluk. D.K. District -574 201 and (2) Lokesha, S/o late Babu, aged about 38 years, R/at Bappalige house, Putturu, Kasaba Village, Putturu Taluku, D. K District - 574 201, do hereby solemnly affirm and state on oath as follows:
2. We submit that during the pendency of the present petition, as per the Advice of well-wishers, our self we have settled our dispute amicably. As per the understanding the petitioner has agreed to pay a sum of Rs.1,00,000/- to me the 2nd respondent and to my sister out of concern, security and on humanitarian consideration in the following manner:
a) Demand Draft No.003258 dated 26/02/2026 for a sum of Rs.50,000/-(Rupees Fifty Thousand), drawn on Axis Bank, Puttur Branch, Bengaluru, in favour of the 2nd Respondent.-3-

b) Demand Draft No.003259 dated 26/02/2026 for a sum of Rs.50,000/- (Rupees Fifty Thousand), drawn on Axis Bank, Pullur Branch, Bengaluru, in favour of Smt. Sharmila, sister of the 2nd Respondent.
3. We state that there is no force or threat or coercion from anyone to settle the dispute and we have settled our dispute amicably.
4. All this is true and correct.
Wherefore, we pray that, this Hon'ble Court may be pleased to allow the application in the interest of justice and equity.
We, Sripathi Rao and Lokesha the deponents herein, do hereby declare that what is stated in the above paragraphs are true to the best of our knowledge, information and belief."
2. They have also filed the application under Section 320(2) read with Section 482 of Cr.P.C seeking permission to compound the offence. For the reasons stated in the joint affidavit accompanying the application IA.No.1/2026 is allowed and the parties are permitted to compound the offence.
3. Learned counsel for respondent No.2 submits that, he is representing respondent No.2 and he is instructed to admit the contents of the affidavit sworn by him. He acknowledges on behalf of respondent No.2, the receipt of Rs.1,00,000/- by way of two Demand Drafts, copies of which are enclosed with the joint memo.

4. Respondent No.2 submits that he has no objection to allow the petition and to quash the criminal proceedings initiated against the petitioner.
5. In view of the above, I am satisfied with the terms of the joint memo and affidavit as mentioned above and deem it appropriate to quash the criminal proceedings. Accordingly, I proceed to pass the following:
ORDER
i) The petition is allowed.
ii) The criminal proceedings initiated against the petitioner - accused No.2 in CC.No.1348/2020 on the file of learned Principal Senior Civil Judge and ACJM, Puttur, Dakshina Kannada in Crime No.5/2020 registered for the offence punishable under Section 304A read with Section 34 of IPC is hereby quashed.
In view of the disposal of main petition, pending interlocutory application does not survive for consideration, accordingly, the same is disposed off.
