ORAL ORDER
This petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to quash the proceedings against the petitioners i.e., respondent Nos.2 to 5 in Crl.Misc.No.137/2024 filed by the respondents herein under Section 12 of Protection of Women from Domestic Violence Act, 2005 r/w Section 6 of Protection of Women from Domestic -4- NC: 2026:KHC-K:1917 CRL.P No. 201175 of 2025 HC-KAR Violence Rules, 2006, pending on the file of Senior Civil Judge and JMFC, Sindhanur.

Today, learned counsel for the respective parties filed an application under Section 359 r/w Section 528 of BNSS 2023, for compounding and quashing the proceedings along with a compromise petition. The application is accompanied with an affidavit of petitioner No.4 and respondent No.1 in this petition, who is acting as a natural guardian of respondent Nos.2 and 3. It is stated in the affidavit that the parties have settled their disputes amicably, since the dispute is purely a matrimonial and private in nature.

In the compromise petition, it is stated by both the parties that the petitioners have offered to transfer a joint family agricultural land bearing Sy.No.195/*/* measuring to an extent of 4 acres 20 guntas situated at Gonavara Village, Sindhanur Taluk and District Raichur in favour of respondents and the same is fully described in the sketch appended to the compromise petition. Accordingly, respondent No.1 being the natural guardian of respondent Nos.2 and 3, accepted the offer as a full and final settlement towards their share and claims of -5- NC: 2026:KHC-K:1917 CRL.P No. 201175 of 2025 HC-KAR maintenance and alimony whatsoever. She also undertakes that there is no further claims and rights whatsoever against the petitioners and her husband namely Shivaraj/accused No.2, who is father of respondent Nos.2 and 3.
4. Considering the nature of dispute and in view of this compromise between the parties, the application and compromise petition are accepted and parties are permitted to settle their dispute as per the terms of compromise petition. Accordingly, I proceed to pass the following:
ORDER
i) The petition is allowed.
ii) The proceedings against the petitioners and respondent No.1's husband i.e., respondent Nos.1 to 6 before the Trial Court in Crl.Misc.No.137/2024 is hereby quashed.
iii) The parties are at liberty to proceed in accordance with the terms of compromise petition.
iv) In view of the settlement arrived at between the parties, learned Senior Civil Judge and JMFC, Sindhanur, is directed to pass an appropriate -6- NC: 2026:KHC-K:1917 CRL.P No. 201175 of 2025 HC-KAR order to release the respondent in Crl.Misc.No.89/2025 by closing the said proceedings.
