ORAL ORDER
This Criminal Revision petition under Section 397 Read with 401 of Cr.P.C., is filed with a prayer to set aside the order dated 24.06.2023 passed in Criminal Misc.No. 195/2022 passed by the Court of V Metropolitan Magistrate Traffic Court, Bangalore, and the Judgment and the Order dated 06.03.2025 passed in Criminal Appeal No. 1014/2023 by the Court of LIX Additional City Civil and Sessions Judge, Bangalore City.

3. The facts leading to filing of this Criminal Revision petition narrated briefly are:
Respondent No.1 herein has filed Criminal Misc. No. 195/2022 before the Court of V Metropolitan Magistrate and Traffic Court at Bangalore, under Section 12 of the Protection of Women from Domestic Violence Act, 2005, against respondent No.2 herein who is her husband and also against her in-laws. Petitioner is the father-in-law of respondent No.1 herein and father of respondent No.2. In the said proceedings, respondent No.1 had filed IA Nos. 1 and 2 seeking monetary and residential reliefs. The trial Court by Order dated 24.06.2023 passed on IA Nos.1 and 2 had directed the husband/respondent No.2 herein to pay maintenance of Rs.5,000/- per month to his wife and two children from the date of filing of the petition till disposal of the case and he was also prohibited from committing any act of domestic violence against his wife and children.
Aggrieved by the said order, respondent No.1 herein had filed Criminal Appeal No.1014/2023 and Criminal Appeal -5- NC: 2026:KHC:11881 CRL.RP No. 1024 of 2025 HC-KAR No.1015/2023 before the Court of LXI Additional City Civil Judge, Bangalore, as provided under Section 29 of the Protection of Women from Domestic Violence Act, 2005. The Appellate Court by common judgment and order dated 06.03.2025 has allowed Criminal Appeal No. 1014/2023 and had partly allowed Criminal Appeal No. 1015/2023. In Criminal Appeal No.1014/2023, it was held that respondent No.1 herein and her children are entitled for accommodation in one of the house out of five houses constructed in three floors, situated at No.32/1, 4th B Cross, Prabhakar Layout, Vishwanathanagenahalli, R.T.Nagar, Bangalore. Aggrieved by the said order passed in Criminal Appeal No.1014/2023, the petitioner is before this Court.

Learned counsel for the parties jointly submit that the dispute between petitioner and respondent No.1, insofar as providing residential accommodation to respondent No.1 and her children has been settled and respondent No. 2 who is the husband of respondent No.1 -6- NC: 2026:KHC:11881 CRL.RP No. 1024 of 2025 HC-KAR has now come forwarded to provide an alternative accommodation. They submit that compromise petition is accordingly filed before this Court by the petitioner and respondent No.1 and 2 and they pray that this revision petition may be disposed of in terms of the settlement arrived between the parties.
5. The said submission is placed on record and the compromise petition filed before this Court, which is signed by the parties and also by their respective advocates is taken on record.
6. The parties who are present before the Court are identified by their Advocates.
7. In paragraph No.2, of the compromise petition, it is stated as follows:
"2. The Petitioner and the Respondents have settled the above disputes amicably and have entered into this compromise. The parties further submit that there is no collusion, undue influence for entering into this -7- NC: 2026:KHC:11881 CRL.RP No. 1024 of 2025 HC-KAR compromise. The parties submit that they have entered into this compromise on the below mentioned conditions:
A. The Respondent No.2-Devaraj. P- Husband has paid a sum of Rs.4,00,000/- (Rupees Four Lakhs only) by way of DD bearing No.058770 dated 19.02.2026, drawn on Canara Bank Hebbala Branch, in favour of the Respondent No.1-Smt.Nandini.L.M.- wife.
B. The Respondent No.2-Devraj. P- Husband has paid a sum of Rs.5,00,000/- (Ryupees Five Lakhs only) by way of DD bearing No.-058776 dated 23.02.2026 drawn on Canara Bank, Hebballa Branch, in favour of the Respondent No.1-Smt. Nandini L.M- wife.
C. The above said amount paid by the Respondent No.2 in favour of the Respondent No.1 is only towards the accommodation/residence for the ResponentNo.1-wife.
D. The Respondent No1 has agreed to vacate the Matrimonial house within 3 days after receiving the above said amount. The Payment of Rupees Nine Lakhs -8- NC: 2026:KHC:11881 CRL.RP No. 1024 of 2025 HC-KAR received by the Respondent No.1 is only towards the Residence/ Accommodation.
E. The Respondent No.1 herein hereby confirms that in view of the above settlement, she has no further claims against the Petitioner and/or his other family members and not to interfere with the Petitioner' Residence, Except against the Second Respondent.
F. The Respondent No.1 herein hereby undertakes to co-operate to close the disputes between the Parties in Crime No.106/2025 registered by Hebbal PS, now under challenge in Crl.P.No.9235/2025 pending before the Hon'ble High Court of Karnataka, wherein the Respondent No.1 has filed an Impleading Application as proposed Respondent.
Wherefore the parties pray that this Hon'ble Court be pleased to record the terms and conditions of the Compromise and pass the judgment and decree accordingly, in the interest of justice and equity."
8. Respondent No.1 wife, who is present before the Court has admitted receipt of Rs.9,00,000/- from respondent No.2 who is her husband, as stated in paragraph No. 2(A) and (B) of the compromise petition. -9-

In view of the aforesaid, I am of the opinion that this revision petition is required to be disposed of in terms of the settlement arrived between the parties and the impugned order dated 06.03.2025 passed in Criminal Appeal No. 1014/ 2023 by the LIX Additional City Civil and Sessions Judge, Bangalore City, needs to be set aside. Accordingly, the following:
ORDER Criminal Revision Petition is partly allowed. The impugned common Judgment and Order dated 06.03.2025 passed in Criminal Appeal No.1014/2023 by the LIX Additional City Civil and Sessions Judge, Bangalore City, is set aside.
