                       ORAL ORDER

This petition is filed by the sole accused under Section 483 of BNSS praying to grant bail in Crime No.58/2025 Bethamangala Police Station registered for offences punishable under Section 103(1), 109, 352 of BNS.

2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent

-State.

3. Learned counsel for the petitioner would contend that there was no motive for the petitioner to commit the murder of the deceased. The incident has taken place in the sudden quarrel. C.W.1 has sustained two simple injuries. There are no criminal antecedents of -3- NC: 2026:KHC:11869 CRL.P No. 16325 of 2025 HC-KAR the petitioner. The petitioner is labour. As the charge sheet is filed, he is not required for custodial interrogation. With this, he prayed to allow the petition.

Per contra, learned High Court Government Pleader for the respondent -State would contend that the petitioner after quarrel with the deceased went back to his house, brought knife and assaulted with knife on the chest, stomach and other parts of the deceased and at that time, C.W.1 came to rescue him, the petitioner - accused has assaulted him also and caused injuries. C.W.2 to C.W.4 are eye witnesses to the incident. The incident has been captured in CCTV. The post mortem report indicates that the deceased has sustained 13 injuries and cause of his death is stab injury to the chest. Charge sheet materials show prima facie case against the petitioner for offences alleged against him. One of the offences is provided with the punishment of death or imprisonment for life. With this, he prayed to reject the petition. -4-

5. Having heard learned counsels, the Court has perused the charge sheet and other materials placed on record.

The case on prosecution is that on 07.05.2025 at about 08.00 p.m., when accused was consuming alcohol in Balaji Bar and Residency shed along with his friends C.W.5 to C.W.7, at that time, the deceased -Nandish was going by walk. At that time, C.W.5 talked with the said Nandish and on seeing the same the petitioner -accused has abused him in filthy words. At that time, the deceased has also abused him in filthy words and galata took place between them and accused assaulted the deceased with hands on his head and face twice. C.W.1, C.W.3, C.W.5, C.W.6 and C.W.7 pacified the quarrel. Thereafter, the petitioner went to his house and brought knife at about 08.30 p.m., and when the deceased came out of the bar after consuming the alcohol, at that time, the petitioner abused the deceased in filthy words, assaulted him with hands on his head and assaulted him with knife on his -5- NC: 2026:KHC:11869 CRL.P No. 16325 of 2025 HC-KAR head and he fell down and thereafter he assaulted him with knife on neck. At that time, C.W.1 came to rescue him and the petitioner -accused has assaulted him with knife and caused injury near his left ear and left hand. Thereafter, the petitioner -accused assaulted the deceased with the same knife on his chest, stomach and kicked him and ran away along with knife.

7. C.W.1 is injured in the incident and he has sustained two injuries. C.W.2 to 4, who are eyewitnesses to the incident, who has specifically stated the acts of this petitioner assaulting and causing death of the deceased and assaulting C.W.1. The incident has been captured in CCTV and CCTV footage has been collected. The post mortem report indicates that the deceased has sustained 13 injuries and cause of death is stab injury to the chest. Considering the above aspects, there is prima facie case against the petitioner for offences alleged against him. If the petitioner is granted bail, there is threat to prosecution witnesses. One of the offence alleged against the -6- NC: 2026:KHC:11869 CRL.P No. 16325 of 2025 HC-KAR petitioner is punishable with death or imprisonment for life. Considering the above aspects, the petitioner has not made out any grounds for grant bail.

In the result, the petition is dismissed.
