ORAL ORDER
Both the learned counsel for the petitioners and respondent No.2 submit in unison that the dispute between the parties is settled amicably and the memorandum of settlement under Section 89 of CPC read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005 was entered -4- NC: 2026:KHC:11742 CRL.P No. 6284 of 2022 HC-KAR into between them. They also submit that, the parties are filing the joint memo and therefore, pray for allowing the petition and to quash the criminal proceedings.
2. Petitioner Nos.1 to 9 being accused Nos.1 to 9 and respondent No.2 being the informant are present before the Court and they are identified by their respective counsel. They have filed the joint memo which reads as under:
"JOINT MEMO The Petitioner's No.1 to 9 and the Respondent No.2 herein together files the Joint Memo stating that the Petitioner No.1 Chetan.B.N Urf Uday and Respondent No.2 Divyashree.H.S are husband and wife and their marriage was solemnized on 22-03-2020 at Tumakuru Police Samudhaya Bhavana, Tumakuru District as per Hindu Rites and customs and the Petitioners herein are father, mother and relatives of the Petitioner. Whereas now both the parties have arrived into the settlement in lieu of the same the Petitioners have paid the Respondent No.2 the sum of Rs.15,00,000/-(Rupees Fifteen Lakhs only) by way of 2 Demand Drafts bearing No.129368 Dated 04-02-2026 for a sum of Rs. 10,00,000/- and DD bearing No.129367 Dated 04-02- 2026 for another sum of Rs.5,00,000/- so in total the sum of Rs.15,00,000/-which is also being encashed by the Respondent No.2 in pursuance of the same Respondent No.2 herein has withdrawn the Domestic violence case that she had filed against the Petitioners before the Ist ADDITIONAL CIVIL JUDGE, AT HARIHARA and also both parties have withdrawn the on going Divorce case in M.C.NO.45/2024 before the Senior Civil Judge and JMFC Harihara the has agreed to dissolve the Marriage by filing the Mutual Consent Petition. Further also the both the parties have agreed to withdraw all the allegations made against each other and also they have -5- NC: 2026:KHC:11742 CRL.P No. 6284 of 2022 HC-KAR exchanged all the articles gold, silver and other valuables given at the time of Marriage in this regard there are no claims against each other in addition to it the parties also admit that they have no claims in present or in future with respect to any moveable's or immoveable properties belonging to each other existing at present or to be acquired in the future in the present or in future and have signed the Mediation Agreement Dated 06-02-2026 before the Bangalore Mediation Center. Therefore, in lieu of the aforesaid settlement it is most respectfully prayed before this Hon'ble Court to Quash the Entire Criminal Proceedings initiated by the Complainant/Respondents as against these Petitioner's No.1 to 9 herein under Sections-506, 498A, 355, 504, 149, 323, 307, 324 of the Indian Penal Code and also under Sections-3,4 of the Dowry Prohibition Act 1961.. in S.C.No.121/2021 before the Court of the THE COURT OF THE IST ADDITIONAL DISTRICT AND SESSIONS JUDGE, AT DAVANAGERE, in the interest of justice."
3. The memorandum of settlement under Section 89 of CPC read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005 is received by the Court from the Director of the Karnataka Mediation Center.
4. The petitioners and respondent No.2 admit the terms of the compromise as found in the memorandum of settlement and also as stated in the joint memo. Respondent No.2 specifically admit the terms of the compromise and acknowledges the receipt of Rs.15,00,000/- as mentioned in the joint memo. She has no objection to allow the petition and to quash the criminal proceedings. -6-

5. In view of the above, I am satisfied with the terms of the compromise as mentioned and deem it appropriate to quash the criminal proceedings. Accordingly, I proceed to pass the following:
ORDER
i) The petition is allowed.
ii) The criminal proceedings initiated against the petitioner Nos.1 to 9 - accused Nos.1 to 9 in SC.No.121/2021 pending on the file of I Additional District and Sessions Judge, Davanagere, in Crime No.108/2020 for the offence punishable under Sections 506, 498-A, 355, 504, 149, 323, 307, 324 of Indian Penal Code and Sections 3 and 4 Dowry Prohibition Act, is hereby quashed.
