THE OFFENCE P/U/S 354A, 506, 498A, 504 OF IP A/W SEC.3, 4 OF
D.P ACT QUA THE PETITIONER WHO IS ARRAYED AS ACCUSED NO.4.

                         ORAL ORDER

Both the learned counsel for the petitioner and respondent No.2 submit in unison that the dispute between the parties is settled amicably and that they have filed a joint memo in that regard. Accordingly they pray for allowing the petition and to quash the criminal proceedings.

2. The joint memo filed by both learned counsel for the petitioner and respondent No.2 and signed by the parties reads as under:

"JOINT MEMO That the petitioner and respondent No.2 submits as under:-
1. That the petitioner is being the accused No.4 in the complaint filed by the Respondent No.2 before the -3- NC: 2026:KHC:11741 CRL.P No. 7518 of 2022 HC-KAR respondent No.1 Basavanagudi Police complaint and the said complaint is filed under section 498(A), 354 A, 504 of I.P.C., Read with section 3 & 4 of D.P.Act.
2. Further that the parties had settled the dispute and before the BMC in M.C.NO.3030/2022 at Bengaluru and that the respondent No.2 had agreed to support to close the petition filed by this petitioner before this Hon'ble Court and in the same manner that the petitioner will also so support to close the petition in Crl.P.No.7684/2022 & Crl.P.No.1685/2026 which are pending before the Hon'ble High Court of Karnataka.
3. Further that the petitioner is paying sum of Rs.5,00,000/- vied D.D.No.392412..., dated 24/12/2025 and that the respondent No.2 is ready and willing to take the said sum of Rs.5,00,000/- as permanent allimone and there will not be any further claim what so ever between the parties.
4. Further that both the parties are agreed for the said settlement on their one will and wish.

WHEREFORE:- It is prayed that this Hon'ble Court may kindly be pleased to accept the joint memo and quash the C.C.No.37476/2022, pending on the file of the Hon'ble 24th A.C.J.M., at Bengaluru, in the interest of justice."

3. The petitioner and respondent No.2 are present before the Court and they are identified by their respective counsel. They admit the contents of the joint memo. Respondent No.2 specifically admit the terms of compromise. She acknowledges the receipt of Demand Draft for Rs.5,00,000/- as mentioned in the joint memo and that she has no objection to allow the petition and to quash the criminal proceedings.

4. Satisfied with the terms of the compromise learned counsel for the petitioner has filed a memo producing copy of the memorandum of settlement under Section 89 of CPC read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005.

5. The same is placed on record.

6. In view of the above, I am satisfied with the terms of the compromise as mentioned and I deem it appropriate to quash the criminal proceedings. Accordingly, I proceed to pass the following:

ORDER
i) The petition is allowed.
ii) The criminal proceedings initiated against the petitioner - accused No.4 in CC.No.37476/2022 pending on the file of XXIV Additional Chief Judicial Magistrate, Bengaluru in Crime No.230/2022 for the offence punishable under Sections 354-A, 506, 498-A and 504 of Indian Penal Code and Sections 3 and 4 Dowry Prohibition Act, is hereby quashed.
