1. Heard Sri. Sachin C. Angadi, learned counsel for the petitioner and Sri. Praveena Y. Devareddiyavara, learned High Court Government Pleader for the respondent- State.
2. Petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, with the following prayer:
"WHEREFORE, the petitioner/accused most humbly prays that this Hon'ble Court be pleased to allow this petition and enlarge the accused/petitioner on regular bail in Crime No.03/2026 registered by the Navalgund PS, Navalagund, District: Dharwad, offences punishable U/Sec.118(1), 109, 352. 351(2), 351(3) of BNS, pending on the file of Hon'ble Addl. Civil Judge (Jr.Dn.) and JMFC Court, Navalagund, District:
Dharwad in the interest of justice. "
3. Facts in nutshell which are utmost necessary for disposal of the present petition are as under: -3-

4. Sri. Kirankumar S/o. Vasuraddi Kanakannavar, has filed a complaint with Navalgond Police on 02.01.2026. The same was registered in Crime No.3/2026 for the offences punishable under Sections 118(1), 109, 352, 351(2) and 351(3) of Bharatiya Nyaya Sanhita, 2023.
5. Gist of the complaint would reveal that on 01.01.2026 at about 11.30 p.m., in Hebbal Village near Mailaralinga Temple, the complainant was called over telephone by the accused and all of a sudden started assaulting the complainant by throwing two glass bottles on him with an intention to take away his life.
6. Thereafter, they pulled a knife and wanted to stab the complainant. Said blow was escaped by the complainant and there was an injury on the head, left hand finger.
7. On hearing the hue and cry raised by the complainant, Venkatesh S/o. Ravi Dharmannavar came and at that juncture, the accused said to have assaulted said -4- NC: 2026:KHC-D:2974 CRL.P No. 100224 of 2026 HC-KAR Venkatesh also with the glass bottle resulting in injury on the leg and also on hand and the face.
8. Police after registering the case thoroughly investigated the matter and filed the charge sheet.
9. The Wound certificate of the complainant and another injured - Venkatesh are part of the charge sheet materials which would show that both the injured persons have sustained simple injuries and they have been treated in the outpatient department.
10. Taking note of the fact that accused is in custody on and from 02.01.2026 and charge sheet has been filed and nature of injuries are not so grave, the request of the petitioner needs to be granted.
11. The apprehensions expressed by the prosecution can be met with by imposing suitable and stringent conditions.
12. Accordingly, the following:

(i) The petition is allowed.
(ii) Petitioner is directed to be enlarged on bail on executing a bond in a sum of Rs.50,000/- with one surety for the like sum to the satisfaction of the Trial Court.
(iii) Petitioner shall not tamper the prosecution witnesses in any manner.
(iv) Petitioner shall attend the Court regularly.
(v) Petitioner shall not leave the jurisdiction of Dharwad District without prior permission.
Violation of any one of the conditions would entitle the prosecution to seek for cancellation of bail.
