                      ORAL ORDER

This petition is filed by accused No.3 under Section 483 of BNSS praying to grant bail in Crime No.160/2016 of Rajarajeshwari Nagar Police Station registered for offences punishable under Sections 450, 395, 397, 420, 170 of IPC pending in C.C.No.27608/2019 on the file of 46th Additional Chief Metropolitan Magistrate, Bengaluru.

2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent

-State.

3. The petitioner earlier has been granted bail by order dated 29.11.2016 passed in Criminal Miscellaneous No.8339/2016. Thereafter, he has been released on bail -3- NC: 2026:KHC:11871 CRL.P No. 489 of 2026 HC-KAR on executing bail bond for sum of Rs.1,00,000/-. Thereafter the petitioner has not appeared before the Committal Court. NBW has been issued against the petitioner. The petitioner has voluntarily appeared on 15.12.2025 and since then he is in judicial custody. It is submitted that now the case has been committed to the Sessions Court pending in S.C.No.124/2026. It is submitted that the petitioner was suffering from jaundice and other ailments and therefore he could not appear before the committal Court. The petitioner has now deposited Rs.50,000/- towards forfeited bond amount of Rs.1,00,000/-. The said amount required to be appropriated to the State. The petitioner has now undertaken to appear before the Sessions Court and cooperate for speedy disposal of the case. Considering the above aspects, the petitioner has made out grounds for grant of bail with conditions.

4. In the result, the following -4- NC: 2026:KHC:11871 CRL.P No. 489 of 2026 HC-KAR ORDER

i) The petition is allowed.

ii) The petitioner is granted bail in Crime No.160/2016 of Rajarajeshwari Nagar Police Station registered for offences punishable under Sections 450, 395, 397, 420, 170 of IPC pending in S.C.No.124/2026 on the file of 61st Additional City Civil and Sessions Judge, Bengaluru (CCH-62) subject to following conditions:

a) The petitioner -accused No.3 shall execute a personal bond for a sum of Rs.1,00,000/-

with one surety for the likesum to the satisfaction of the trial Court.

b) The petitioner -accused No.3 shall not tamper the prosecution witnesses either directly or indirectly.

c) The petitioner -accused No.3 shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.

The amount deposited by the petitioner in the sum of Rs.50,000/- shall be appropriated to the state.
