                     ORAL ORDER

This petition is filed by the petitioner -accused No.1 under Section 483 of BNSS praying to grant bail in Crime No.237/2025 of Channarayapatna Town Police Station registered for offences punishable under Section 109 read with Section 3(5) pf BNS.

2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent

-State.

Learned counsel for the petitioner would contend that the petitioner has also filed a complaint and it came to be registered in Crime No.238/2025 against the complainant and it is counter complaint. There was quarrel at school function. In that quarrel, two persons have -3- NC: 2026:KHC:11206 CRL.P No. 581 of 2026 HC-KAR sustained injuries and they are simple in nature. In the complaint, the allegation against this petitioner is assaulting one Akul with knife on his left hand. The wound certificate of Akul indicates that he has sustained laceration measuring 4x2x1cm on his left hand and it is stated to be simple in nature. The petitioner is in judicial custody since 29.12.2025 and as major portion of the investigation is over, he is not required for further custodial interrogation. With this, he prayed to allow the petition.

Per contra, learned High Court Government Pleader for the respondent -State would contend that this petitioner with an intention to kill Akul has assaulted him with knife on his left hand and caused bleeding injury. The wound certificate of Akul indicate that he has sustained laceration measuring 4x2x1cm over left hand. The investigation is in progress. If the petitioner is granted bail, he will hamper the investigation and tamper the -4- NC: 2026:KHC:11206 CRL.P No. 581 of 2026 HC-KAR prosecution witnesses. With this, he prayed to reject the petition.

5. Having heard learned counsels, the Court has perused the FIR, complaint and other materials placed on record.

As per averments of the complaint, there was school function and in that function, at about 09.30p.m., when complainant was watching dance, at that time accused Nos.1 to 3 came there shouting and complainant has stated to them not to shout. At that time accused No.1 abused him. Accused No.2 with intention to kill him has assaulted with knife on his back, accused No.3 assaulted on his head with some key and accused No.1 assaulted Akul with knife on his left hand and caused injury. Considering the said overtact alleged against this petitioner, he has assaulting with knife on hand of Akul. The wound certificate of Akul indicates that he has sustained laceration measuring 4x2x1cm over his left hand and it is stated to be simple in nature. The said part i.e., -5- NC: 2026:KHC:11206 CRL.P No. 581 of 2026 HC-KAR hand is not vital part. The petitioner is in judicial custody since 29.12.2025. As the major portion of investigation is over, he is not required for further custodial interrogation. There are no criminal antecedents of the petitioner. Considering the above aspects, the petitioner has made out case for grant of bail with conditions.

7. In the result, the following ORDER

i) The petition is allowed.

ii) The petitioner is granted bail in Crime No.237/2025 of Channarayapatna Town Police Station subject of following conditions:

a) The petitioner -accused No.1 shall execute bail bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court. -6-

b) The petitioner -accused No.1 shall not tamper the prosecution witnesses either directly or indirectly.

c) The petitioner -accused No.1 shall co- operate with Investing Officer in the investigation.

d) The petitioner -accused No.1 shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
