                      ORAL ORDER

Accused in Spl.C.No.872/2025 pending before the Court of the Additional City Civil and Sessions Judge, FTSC-I, Bengaluru, arising out of Crime No.55/2025 registered by Hulimavu Police Station, Benglauru City, for offences punishable under Sections 3(b), 4, 5(m) and 6 of the Protection of Children from sexual Offences Act, 2012 (for short 'POCSO Act') is before this Court in this successive bail application filed under Section 483 of BNSS, 2023 read with Section 439 of Cr.PC seeking regular bail.

2. Heard the learned counsel for the parties. -3-

FIR in Crime No.55/2025 was registered by Hulimavu Police Station, Benglauru initially for offences punishable under Sections 8 and 4(2) of the POCSO Act, against the petitioner herein, based on the first information dated 21.02.2025 received from respondent No.2 who is the mother of the victim girl aged about 11 years.

4. During the course of investigation of the case, petitioner herein was arrested on 23.02.2025 and remanded to judicial custody. His bail application filed before the Trial Court was rejected and therefore, he has approached this Court in Crl.P.No.7643/2025 which was dismissed as withdrawn on 03.07.2025 with liberty to the petitioner to renew his bail application after examination of the victim girl gets completed before the Trial Court. The petitioner thereafter had filed a fresh bail application before the Trial Court in Crl.Misc.No.8868/2025 which was rejected on 27.10.2025. It is under these circumstances, -4- NC: 2026:KHC:10982 CRL.P No. 15199 of 2025 HC-KAR the petitioner is before this Court in this successive bail application.

5. Learned counsel for the petitioner submits that victim girl has been examined as PW.1 before the Trial Court. Petitioner who is a married man having family, is in custody for the last one year. He has no other criminal antecedents. Accordingly, he prays to allow the petition.

6. Per contra, learned HCGP has opposed the petition and submits that mother of the victim girl is being examined as PW.2 before the Trial Court. Petitioner hails from Assam State and in the event he is enlarged on bail, it would be difficult to secure his presence. The chances of petitioner tampering with the prosecution witnesses cannot be ruled out, in the event he is enlarged on bail. Accordingly, he prays to dismiss the petition.

In the first information which is submitted by the mother of the victim girl on 21.02.2025, she has stated that she was residing in Bengaluru along with her two -5- NC: 2026:KHC:10982 CRL.P No. 15199 of 2025 HC-KAR daughters, after her marriage was dissolved. In the year 2020 petitioner got acquainted to her and in the year 2024 he proposed to have a live-in relationship with the first informant and also promised to take care of her daughters. Petitioner allegedly was visiting the house of first informant during the weekends and was staying overnight. On 19.02.2025, petitioner who came to the house of first informant allegedly sent out the younger daughter on the pretext of buying something and thereafter, caught hold of elder daughter of first informant who is victim girl in the present case and after removing her pants inserted his finger into her private part. At that time the first informant who heard her daughter screaming came inside the house and petitioner allegedly thereafter escaped from the house. It is in this background, FIR was registered against the petitioner in Crime No.55/2025. The police after investigation have filed the charge sheet against him for the aforesaid offence. -6-

8. The victim girl has supported the case of the prosecution in her statement recorded under Section 164 of Cr.PC and also during the course of her deposition before the Trial Court as PW.1. Before the Trial Court, the mother of the victim girl is partly examined as PW.2.

9. The other material charge sheet witnesses including the sister of victim are yet to be examined. Petitioner hails from Assam State and as rightly pointed out by learned HCGP, in the event he is enlarged on bail, the chances of he fleeing away from justice cannot be ruled out. In addition to the same, having regard to his relationship with the first informant, the chances of he tampering with the prosecution witnesses also cannot be ruled out. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of bail at this stage cannot be entertained. Considering the stage of the case and the period of petitioners incarceration, I am of the opinion that ends of justice can be secured if the -7- NC: 2026:KHC:10982 CRL.P No. 15199 of 2025 HC-KAR Trial Court is requested to expedite trial and dispose of the case on merits. Accordingly, the following:

ORDER i. The Criminal revision petition is dismissed with a request to the Trial Court to expedite trial and dispose of the case as early as possible.
