                          ORAL ORDER

This petition is filed by Accused No.6 under Section 483 of BNSS praying to grant bail in Crime No.191/2025 of Magadi Road Police Station registered for offences punishable under Sections 109, 118(1), 126(6), 61, 190 read with Section 3(5) of BNS and Section 25(1B)(B) of Arms Act.

2. Heard learned counsel for petitioner and learned Addl.SPP for respondent/State.

Learned counsel for petitioner would contend that accused Nos.1 and 4 who are similarly placed to that of petitioner have been granted bail by this Court in Crl.P.No.14072/2025 by order dated 18.11.2025. Therefore, the petitioner is entitled for grant of bail on the -3- NC: 2026:KHC:10770 CRL.P No. 14075 of 2025 HC-KAR ground of parity. Accused Nos.7 and 8 have been granted bail by the Sessions Court. As the charge sheet is filed, petitioner is not required for further custodial interrogation. With this he prayed to allow the petition.

4. Per contra, learned Addl.SPP would contend that as per charge sheet, accused No.1 was having grudge against CW.2 and he and his followers have assaulted him. The wound certificate of CW.2 indicates that he has sustained two simple injuries. CW.11 is the eyewitness to the incident. With this he prayed to reject the petition.

5. Having heard the learned counsel, the Court has perused FIR, complaint and other materials placed on record.

6. This Court while granting bail to accused Nos.1 and 4 in the order dated 18.11.2025 passed in Criminal petition 14072/2025 has observed as under:

7. As per case of the prosecution, the accused persons have assaulted C.W.2 with weapons like iron long chopper, machete and dagger. The wound -4- NC: 2026:KHC:10770 CRL.P No. 14075 of 2025 HC-KAR certificate of C.W.2 indicates that he has sustained two simple injuries. The only eyewitness to the incident is C.W.11 and he has not stated overt act of each of accused persons. The petitioner No.1 - accused No.1 has been granted bail in Crime No.440/2020 of Chittoor Town Police Station. As the charge sheet is filed, petitioners are not required for further custodial interrogation. Petitioners are in judicial custody since 19.08.2025. Considering the above aspects, petitioners have made out case for grant of bail with conditions.

7. The petitioner is also similarly placed to that of accused Nos.1 and 4, who have been granted a bail by this Court. Therefore, the petitioner is entitled for grant of bail on the ground of parity. As the charge sheet is filed, the petitioner is not required for further custodial interrogation. The petitioner is in judicial custody since 18.08.2025. Petitioner is not having any criminal antecedents. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions.

NC: 2026:KHC:10770 CRL.P No. 14075 of 2025 HC-KAR ORDER The petition is allowed. Petitioner is granted bail in Crime No.191/2025 of Magadi Road Police Station, subject to following conditions:
(i) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for likesum to the satisfaction of the jurisdictional Court.
(ii) Petitioner shall not tamper the prosecution witnesses either directly or indirectly.
(iii) Petitioner shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
