ORAL ORDER
The petitioners being accused Nos. 1 to 11 in C.C.No.8707/2021 on the file of the learned Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru registered for the offences punishable under Sections 143, 427, 354-B, 448, 323, 504, 506 read with Section 149 of IPC, have filed this petition seeking to quash the criminal proceedings initiated against them, on the basis of the FIR lodged by respondent No.2.
2. Heard Sri. Manjunatha G, learned counsel for the petitioners and Sri. Rangaswamy R, learned High Court Government Pleader for respondent No.2. Perused the materials on record.
3. In view of the rival contentions urged by the learned counsel for the respective parties, the point that would arise for my consideration is:
"Whether the petitioners have made out any grounds to allow the petition and to quash the criminal proceedings initiated against them?"-6-

REASONS
4. Respondent No.2 herein filed the First Information with Soladevanahalli Police Station against accused Nos. 1 to 11 alleging commission of offences punishable under Sections 143, 427, 354-B, 448, 323, 504, 506 read with Section 149 of IPC. Accordingly, FIR in Cr.No.67/2021 of Soladevanahalli Police Station came to be registered. After investigation, the charge sheet came to be filed against the petitioners for the aforesaid offences. Learned Magistrate took cognizance of the offences and registered criminal case in C.C.No.8707/2021.
5. Being aggrieved by the summons issued against them, accused Nos. 1 to 11 are before this Court seeking to quash the criminal proceedings.
6. It is the contention of the learned counsel for the petitioners that the marriage between petitioner No.1 and respondent No.1 was performed on 25.05.2008. Several complaints and counter complaints came to be filed against one another. But subsequently, the dispute between the parties was -7- NC: 2026:KHC:10725 CRL.P No. 6885 of 2021 HC-KAR settled amicably and compromise petition was filed in M.C.No.4511/2020 on the file of learned Principal II Addl. Judge, Family Court at Bangalore by respondent No.1 against the petitioners. As per the terms of the said compromise, both the parties have agreed to withdraw the complaints filed against one another. The said compromise petition filed before the Lokadalath was accepted resulting in dissolution of marriage between petitioner No.1 and respondent No.1.
7. Learned counsel for the petitioners further submits that in view of the fact that the marriage is dissolved, respondent No.1 has lost interest in prosecuting the criminal case. Therefore, she has not appeared before the Court.
8. Learned counsel for the petitioners also submits that pursuant to the compromise, O.S.No.120/2021 filed by petitioner No.1 against respondent No.1 is also withdrawn.
9. Learned counsel for the petitioners produced certified copy of the order sheet dated 26.06.2023 in M.C.No.4511/2020 which reads as under:
"Case advanced.
Both parties present. Counsel also present.-8-
NC: 2026:KHC:10725 CRL.P No. 6885 of 2021 HC-KAR Counsel for petitioner filed joint compromise petition U/o 23 Rule 3 CPC and prayed to allow the same.
The contents of compromise petition are read over to the parties, the parties have admitted the same and even the counsel for the parties have also submitted to the court that, they have explained the contents of compromise to the parties.
In view of the above, I am satisfied that the parties are getting compromise at their free will without any undue influence coercion and even they are taking care of the interest of the child. Therefore, in view of the above, I proceed to pass the following:
ORDER Joint compromise petition filed by the parties is hereby allowed.
Office is directed to draw decree accordingly and the joint compromise petition should form part and parcel of the decree."

As per para-11 of the compromise petition filed in M.C.No.4511/2020, respondent No.1 herein undertook to withdraw the criminal case in C.C.No.8707/2021 pending on the file of the learned CJM at Bangalore. Similarly, petitioner No.1 herein undertook to withdraw the criminal proceedings in C.C.No.16544/2021 pending before very same Court, forthwith. -9-

11. It is noticed that respondent No.1 even though representing through her advocate, is not appearing before the Court.

Even though serious allegations are made by respondent No.1 against petitioners who are none other than her husband and his family members, since the dispute between the husband and wife is settled amicably and respondent No.1 has undertaken to withdraw the criminal case in C.C.No.8707/2021, as per the terms of the compromise, I deem it appropriate to accept the contentions of the petitioners and to allow the petition to quash the criminal proceedings, Hence, I proceed to pass the following:
ORDER
(i) Criminal Petition is allowed.
(ii) The criminal proceedings initiated
against the petitioners in
C.C.No.8707/2021 (Cr.No.67/2021 of Soladevanahalli Police Station) pending on the file of the learned Chief Judicial Magistrate, Bengaluru, registered for the offences punishable under Sections 143, 427, 354-B, 448,
