                       ORAL ORDER

This petition is filed by the accused No.1 under Section 482 of BNSS praying to grant anticipatory bail in Crime No.481/2025 of Basaveshwara Nagar Police Station registered for offences punishable under Sections 318(4), 319(1) 3(5) of BNS.

2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent

-State.

Learned counsel for the petitioner would contend that the petitioner has been appointed as Food Safety Mitra and she has issued certificate of competence from 26.08.2022 and it's expiry date was 14.09.2024 and subsequently it has been extended till 07.09.2034. The petitioner is authorized to conduct training and issued -3- NC: 2026:KHC:10352 CRL.P No. 86 of 2026 HC-KAR receipt. The petitioner is now ready to co-operate with the police in Investigation. The allegations made in the complaint are not true. The petitioner is woman. There are no criminal antecedents of the petitioner. With this she prayed to allow the petition.

4. Per contra, learned High Court Government Pleader for the respondent -State would contend that the certificate of the petitioner has expired. Before it was revalidated, she without giving training has collected fees from the businessman. The petitioner is required for custodial interrogation. With this, he prayed to reject the petition.

5. Having heard learned counsels, the Court has perused FIR, complaint and other materials placed on record.

On perusal of the complaint, it is indicated that even inspite of instructions, some of the Food Safety Mitras are collecting more fees than the prescribed from -4- NC: 2026:KHC:10352 CRL.P No. 86 of 2026 HC-KAR the business persons and this petitioner is stated to be one among them. The petitioner is issued with Certificate of Competence under Food Safety Mitra scheme. Whether the petitioner has committed offence as alleged is matter of investigation. The petitioner has undertaken to co-operate with the Investigating Officer in the investigation and abide by any conditions to be imposed by this Court. There are no criminal antecedents of the petitioner. Considering the above aspect, the petitioner has made out case for grant of anticipatory bail with conditions.

7. In the result, the following ORDER

i) The petition is allowed.

ii) The petitioner -accused No.1 is ordered to be released on bail in the event of her arrest in Crime No.481/2025 of Basaveshwara Nagar Police Station subject to following conditions: -5-

a) The petitioner -accused No.1 shall voluntarily appear before the Investigating Officer within 15 days from this day and execute bail bond for Rs.1,00,000/- with one surety for the likesum to the satisfaction of the Investigating Officer.
b) The petitioner -accused No.1 shall appear before Investigating Officer whenever called for are co-operate for investigation.
c) The petitioner -accused No.1 shall not directly or indirectly make an inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such a facts to the court or police officer or tamper with the evidence.
d) The petitioner -accused No.1 shall appear before Investigating Officer on every Sunday between 10a.m. and 02 p.m. for a period of -6- NC: 2026:KHC:10352 CRL.P No. 86 of 2026 HC-KAR 01 month or till filing of the final report whichever is earlier.
