                          ORAL ORDER

This writ petition is filed under Articles 226 & 227 of the Constitution of India, seeking the following reliefs:

"i. Issue a writ of mandamus or any other appropriate writ or direction directing the respondent to consider the representation dated 01.01.2026 submitted by the petitioner vide Annexure-A. ii. Direct the respondents to pay the cost of writ proceedings to the petitioner and grant such other relief or reliefs as this Hon'ble Court may be pleased to grant in the interest of justice and equity."

2. The brief facts of the case are that, the petitioner was appointed as an Accountant on 30.08.2017 and was working in the fourth respondent-Corporation. She worked at several places and, upon promotion as Accounts Superintendent, was transferred to the third respondent- Corporation.

3. By order dated 31.12.2025 (Annexure-E), the State Government transferred the petitioner from Mangaluru City Corporation to Mysuru City Corporation. Thereafter, the petitioner submitted a representation dated 01.01.2026 (Annexure-A) to the third respondent seeking to be relieved from service to enable her to report to the fourth respondent-Corporation. Since the third respondent has not issued the relieving order, the petitioner has approached this Court.

4. The Government, by order dated 31.12.2025, transferred the petitioner from the third respondent- Corporation to the fourth respondent-Corporation and, correspondingly, transferred the fifth respondent from the fourth respondent-Corporation to the third respondent- Corporation. Once the Government has passed the transfer order, the third respondent is required to relieve the petitioner to enable her to report to the fourth respondent-Corporation.

5. Since the third respondent has not relieved the petitioner in terms of the transfer order dated 31.12.2025 (Annexure-E), the third respondent is hereby directed to relieve the petitioner from the post of Accounts Superintendent at Mangaluru City Corporation and permit her to report to Mysuru City Corporation. The fifth respondent is also directed to forthwith report for duty at the third respondent-Mangaluru City Corporation. In the event the fifth respondent fails to report to Mangaluru City Corporation forthwith, the competent authority is directed to take appropriate action against the fifth respondent, in accordance with law.

With the above observations, the writ petition stands disposed of.
