The petition is listed today for Preliminary Hearing in 'B' Group and the name of the petitioner is shown in the cause list.
When the matter was called, the name of the petitioner was called out thrice in the open Court. However, there is no representation on behalf of the petitioner, either in person or through video conferencing. The petitioner is absent.
In view of the demise of the counsel for the petitioner, this Court had directed issuance of notice to the petitioner, and the same has been duly served. The office was also directed to delete the name of the counsel, Sri Aditya A. Magadum, from the cause list and to print the name of the petitioner in the cause list. Accordingly, the matter is listed today with the name of the petitioner shown in the cause list.
As could be seen from the records, the petition was filed in the year 2018 and has been pending for about eight years. Despite service of notice, the petitioner has neither appeared before this Court nor engaged any counsel to represent him. In the circumstances, it appears that the petitioner is not interested -4- NC: 2026:KHC-D:4896 WP No. 100693 of 2018 HC-KAR in prosecuting the petition. Accordingly, the writ petition is dismissed for non-prosecution.
Because of dismissal of the petition, interim order if any stands discharged and pending interlocutory applications if any are disposed of.
