ORAL ORDER

1. The complainant has filed the present complaint alleging wilful disobedience of the order dated 18.12.2024 passed by the learned Single Judge of this Court in Writ Petition No.34518/2024. In terms of the said order, the Court had passed an interim order to the effect that the complainant will not be dispossessed from the subject premises without due process of law. Additionally, the -3- NC: 2026:KHC:17964-DB CCC No. 150 of 2025 HC-KAR Court had noted that if the petitioner had participated in an auction or makes an offer in exercise of the 'Right of First Refusal' the petitioner shall not be prejudiced by the institution of the petition. Apparently, the petitioners offer for the shop in question has not been considered. Further, the petitioners have also not been afforded right of first refusal on the ground that the allocation of the shop in question was reserved for a reserved category and the petitioners do not belong to that category.
2. We note that the action of the respondents does not fall foul of the order, the disobedience of which is complained. The complaint is accordingly closed. We, however, clarify that this would not preclude the petitioners from agitating their grievance in accordance with law.
