THIS APPEAL, COMING ON FOR PRELIMINARY HEARING,
THIS DAY, JUDGMENT WAS DELIVERED THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE D K SINGH
and
HON'BLE MR. JUSTICE RAJESH RAI K
ORAL JUDGMENT
(PER: HON'BLE MR. JUSTICE D K SINGH) The present writ appeal has been filed by M/s. Karnataka State Warehousing Corporation (for short 'the Corporation') impugning the judgment and order dated 10.12.2024 passed in Review Petition No.428/2024 filed by the respondent, who was an employee of the appellant/Corporation and he stood retired from service w.e.f. 31.10.2019.
2. The respondent/employee's retirement dues were not paid even after five years from the date of his retirement. Therefore, he filed writ petition and the learned Single Judge vide judgment and order dated 23.08.2024 allowed the writ petition directing the appellant/Corporation to pay the retirement benefits. However, inadvertently no order for payment of interest was passed and therefore, review -3- NC: 2025:KHC:41817-DB WA No. 1885 of 2024 HC-KAR petition came to be filed by the respondent/employee. In the said review petition, the learned Single Judge has directed the appellant/Corporation to pay interest @ 9% p.a on the retirement dues to the respondent/employee from the date of his retirement till the date of payment.
3. We do not find any scope to interfere with the impugned judgment and order of grant of interest passed in the Review Petition, on the retirement benefits of the employee and therefore, we dismiss this writ appeal.
