ORAL JUDGMENT
1. Accused 2 to 5 before the Trial Court who are appellants 1 to 4 before this Court, have preferred this appeal against the impugned order dated 23.08.2025 in Crl.Misc.No.745/2025 passed by the II Additional District and Sessions Judge, Shivamogga, by which order the Anticipatory Bail filed under Section 482 of BNSS, 2023, came to be dismissed.

The brief facts leading to this appeal are that, on the basis of complaint filed by one Satisha @ Tambi, Hosanagara Police have registered the case in Crime No.55/2025 against accused 1 to 5 for the commission of offences under sections 352, 118(1), 115(2), 351(2), 109(1), 190 of BNS, 2023 and sections 3(1)(r)(s), 3(2)(va) of the SC & ST (Prevention of Atrocities) Amendment Act, 2015.
3. The appellants have filed application under Section 482 of BNSS, 2023 for grant of Anticipatory bail. Same -4- NC: 2025:KHC:44194 CRL.A No. 2108 of 2025 HC-KAR came to be rejected by the Trial Court on 23.08.2025. Being aggrieved by this order, the appellants have preferred this appeal.
4. I have examined the materials placed before this Court. Hosanagara Police have already submitted charge sheet against accused 1 to 5 for the offences under sections 352, 118(1), 115(2), 351(2), 109(1), 190 of BNS, 2023 and sections 3(1)(r)(s), 3(2)(va) of the SC & ST (Prevention of Atrocities) Amendment Act, 2015.
5. The substance of Column 17 of the charge sheet reads as hereunder:

6. On perusal of the charge sheet, it is crystal clear that present appellants are not required for further investigation. It is submitted that accused No.1 - Tiller -7- NC: 2025:KHC:44194 CRL.A No. 2108 of 2025 HC-KAR Manju who has assaulted the injured with club, is in judicial custody. The role of the appellants is that they have assaulted the injured with their hands. The charge sheet reveals that CW-1 sustained only simple injuries.
7. The alleged commission of offences are not punishable with death or imprisonment for life. The Trial Court has dismissed the application on the ground that the accused are required for investigation. Since the charge sheet is already filed, the accused are not required for investigation. Even during the investigation, the Investigating Officer had not issued the arrest notice under Section 35 of BNSS, 2023.
8. Considering the above facts and circumstances, it is just and proper to allow this appeal. Accordingly, I proceed to pass the following:
ORDER
(i) The Criminal Appeal is allowed.-8-

(ii) The impugned order dated 23.08.2025 in Crl.Misc.No.745/2025 passed by the II Additional District and Sessions Judge, Shivamogga, is set aside. Consequently, the application filed under Section 482 of BNSS, 2023 is allowed.
(iii) Appellants shall be released on bail on executing self-bond for Rs.1,00,000/- with one surety each for the likesum to the satisfaction of the Special Court.
(iv) Appellants shall not tamper or threaten the prosecution witnesses in any manner.
(v) Appellants are directed to appear before the Trial Court on all the dates of hearing.
