ORAL JUDGMENT
(PER: HON'BLE MR. JUSTICE JAYANT BANERJI) Sri. V. K. Ramesha, learned counsel for the appellant is present. Sri. Sateesh S. Kudtharkar, learned counsel appears for the respondent. The respondent is also present in person.
2. On record is a report from the Karnataka Mediation Centre1 reporting settlement entered into between the 1 KMC -4- NC: 2025:KHC:47721-DB MFA No. 3464 of 2024 C/W MFA No. 3458 of 2024 HC-KAR appellant and the respondent on 29.10.2025. As is evident from perusal of the memorandum of settlement enclosed with the report of the KMC, the parties have agreed to withdraw/close/quash the cases pending between them. Both the appellant and the respondent have mutually agreed to re- unite and resume their marital life. Other terms are also mentioned.
3. Learned counsel for the appellant states that the appellant has met with an accident and was admitted in the ICU and he has now been discharged. He, however, does not dispute the factum of the agreement and that the signature appearing on the memorandum of settlement is that of the appellant, who had signed in the presence of V.K. Ramesha, learned counsel for the appellant.
4. The respondent-wife is present in Court, who has been identified by the learned counsel.
5. In view of the aforesaid, this Court proceeds to consider the aforesaid appeals. -5-

6. MFA No.3464/2024 was filed by the husband challenging the order of the Principal Judge, Family Court, Bengaluru in M.C. No.800/2016, which was filed under Section 13(1)(i-a)(i-b) of the Hindu Marriage Act, 19552. By the impugned order, the aforesaid M.C. No.800/2016 was dismissed.
7. The other MFA No.3458/2024 has been filed for setting aside the judgment and decree dated 01.02.2024 passed by the Principal Judge, Family Court at Bengaluru in M.C. No.4216/2015 whereby the petition filed by the wife under Section 9 of the HM Act was allowed. This appeal also was filed by the husband.
8. In view of the aforesaid settlement, nothing further survives in the aforesaid appeals and the appeals are therefore, dismissed.
The parties are directed to comply with the terms of the agreement. The respondent-wife shall resume cohabitation with her husband.
2 HM Act -6- NC: 2025:KHC:47721-DB MFA No. 3464 of 2024 C/W MFA No. 3458 of 2024 HC-KAR Let a decree be made. The memorandum of settlement aforesaid shall form part of the decree.
