                            JUDGMENT

This appeal arises from the judgment and award dated 26.06.2015, issued by the Motor Accidents Claims Tribunal and II Additional Senior Civil Judge, Mangalore, D.K., in MVC.No.1821/2011.

2. I have heard learned counsel for the parties and thoroughly examined the Trial Court Records.

3. The claimants filed a petition under Section 166 of the Motor Vehicles Act, seeking fair and just compensation for the death of Sathish M, who passed away due to accidental injuries on 21.10.2011. At the time of the accident, the deceased was 26 years old. In the absence of evidence regarding his income, the notional income of the deceased is assessed at Rs.6,500/- per month, -3- NC: 2024:KHC:24189 MFA No. 6932 of 2018 based on the chart prepared by the Karnataka Legal Aid Services Authority, as opposed to the Rs.6,000/- assessed by the tribunal.

4. By adding 40% for future prospects and deducting 1/4th for personal and living expenses, and adopted multiplier of 17, the compensation awarded by the tribunal is reevaluated as follows:

5. Accordingly, I pass the following:

i) The appeal is allowed-in-part.
ii) The judgment of the Claims Tribunal is modified. The claimant is entitled for a total compensation of Rs.15,82,300/- as opposed to Rs.11,34,000/- awarded by the Tribunal.
iii) The enhanced compensation amount of Rs.4,48,300/-

(i.e.,Rs.15,82,300 - Rs.11,34,000) shall carry interest at -4- NC: 2024:KHC:24189 MFA No. 6932 of 2018 the rate of 6% per annum from the date of filing the petition till the date of realization.

iv) The claimants would be disentitled to the interest for the delayed period of 1062 days in filing this appeal.

To this extent, the impugned award stands modified.
