1. The instant application has been preferred by the petitioner for modification of the order dated 16.06.2023 passed in Criminal Appeal (SJ) No. 1294 of 2004 whereby the judgment of conviction was sustained, however, on the question of sentence, the same was modified to the extent that the appellant No.2 Chhakori Pandit was sentenced for period already undergone subject to payment of fine of Rs.20,000/-.

2. Learned counsel for the petitioner submits that for the reasons stated in this application, the amount could not be deposited within stipulated time and as a result, the appellant/petitioner namely, Chhakori Pandit has been taken into custody; as such, the order may be modified by giving four weeks' time to deposit the fine amount.

3. Learned counsel for the opposite party does not have any serious objection.

4. Having regard to the aforesaid facts of the case and the averments made in this application, the same is allowed. Consequently, the order dated 16.06.2023 passed in Cr.Appeal (SJ) 1294 of2004 is modified to the extent that the petitioner herein shall pay an amount of Rs. 20,000/- within a period of four weeks from today.

It goes without saying that the moment the petitioner herein shall deposit the said amount as per the order dated 16.06.2023, he shall be released after due procedure.

5. With the aforesaid modification, the instant application stands allowed.
