2. Mr. Sanjeev Thakur submits that after going through the trial courts judgment it is clear that petitioner has been acquitted for the charge under Section 406 IPC; as such the trial courts has accepted that there was no delivery of property and since there was no delivery of property, Section 420 IPC will not be attracted.
3. Mr. Tapas Roy, learned APP shall reply on this issue on the next date of hearing.
