10.10.2024 There is no representation on behalf of the respondent. This appeal has been listed for final hearing. Perusal of the record reveals that no substantial question of law has been framed. The matter was, therefore, considered for framing of substantial question of law.
Heard learned counsel for the appellant and I have gone through the record of the file as well as grounds taken. The appellant has proposed substantial questions of law in Para-(xxviii) of the appeal and while going through the same, I do not find that such questions raised are substantial questions of law and the following substantial question of law arises for consideration in this appeal:-
"Whether the judgment of the Appellate Court reversing the judgment of trial court is perverse ?"
This appeal is admitted on the aforesaid substantial question of law.
Issue post-admission notice to the respondent, returnable within four weeks. Requisite steps for service within a week's time. 2
