02.04.2021 The State Human Rights Commission made enquiry into a complaint made to it and after such enquiry in exercise of powers under Section 19(2) of J&K Protection of Human Rights Act, 1997 has approached the High Court for appropriate directions, orders or writs as the court may deem necessary in the facts and circumstances of the case.
The aforesaid reference made by the Commission under Section 19(2) of the Act has been registered as a writ petition.
We have gone through the judgment of the Commission dated 27.09.2018 and find that the matter now requires adjudication on two aspects. The first is investigation in the matter of custodial death of Gh. Rasool Malik, who was aged about 18 years and the second is compensation, if any, payable to the next of kins of the deceased in the event of violation of human rights.
