Learned counsel for the petitioner seeks permission to withdraw the petition with liberty to approach the appellate authority i.e. Commissioner Shimla Division, Shimla with a prayer that the petitioner is ready and willing to vacate the premises within two weeks. Prayer allowed.
2. Accordingly, the petitioner is permitted to withdraw the petition with liberty as aforesaid. 1

3. In case the petitioner approaches the Commissioner Shimla Division, as aforesaid, it is expected that the Commissioner shall immediately take a decision on the request of the petitioner. Pending applications, if any, also stand disposed of.
