CMP(T) No. 376 of 2023 This application has been filed for release of amount awarded in favour of applicant/petitioner, vide order dated 24.9.2015, passed by the erstwhile Tribunal in OA No. 1806 of 2015, titled Bhasker Ram Vs. State of HP & ors.
In writ petition No. 1894 of 2016, preferred by the State, the order passed by the erstwhile Tribunal was upheld by this High Court, vide judgment dated 24.7.2017. SLP No. 28104 of 2018 preferred against the said order also stands dismissed on 13.4.2023.
For non-implementation of the order passed by the erstwhile Tribunal, petitioner has preferred contempt petition COPC(T) No. 97 of 2020 whereafter in the contempt petition, department has deposited Rs. 3,40,598/- in the Registry of this Court in October, 2020.
Respondents have failed to impart appropriate instructions despite granting opportunity as according to instructions received by the office of Advocate General, concerned Officer is seeking time to have permission of the ::: Downloaded on - 27/07/2023 20:37:48 :::CIS

Government for granting no objection for release of the amount.

After adjudication of the matter upto Hon'ble Supreme Court such permission is not required at all. The prayer of the respondent to seek further time is absurd.
In aforesaid circumstances, I find no legal impediment in releasing the amount in favour of the applicant/petitioner.
rIn view of above, the amount deposited in the Registry of this Court, along with upto date interest is ordered to be released in favour of the applicant/petitioner by remitting the same in his savings bank account mentioned in para-6 of the application. Photocopy of the front page of the passbook has also been enclosed with the application.
The application stands disposed of.
