After having heard the learned counsel representing the parties and perused the averments contained in the application, this Court is not persuaded to grant the aforesaid relief, as claimed for.

In view of the aforesaid submissions, learned counsel representing the applicant-appellant seeks permission to withdraw the instant application with liberty file afresh, if need so arises.

Consequently, the instant application is dismissed as withdrawn, with liberty as aforesaid.

The application stands disposed of.

Though, having taken note of the fact that commercial quantity of contraband i.e. 5.5 kg. has been recovered from the possession of the petitioner, there appears to be no reason to consider the request made on behalf of the petitioner for grant of bail, but yet this Court deems it fit to direct learned Additional Advocate General to ascertain factum with regard to illness of bail petitioner, so that prayer made on his behalf for grant of bail on medical ground, if any, is considered on the next date of hearing.
