ORAL ORDER
Rule. Learned APP waives service of notice of rule for respondent - State of Gujarat.
1. By way of the present application, the applicant has sought parole leave on the ground of doing the agricultural activities, as the monsoon season is likely to commence shortly.
2. Heard learned advocates appearing for the respective parties. Perused the documents produced along with the application as well as the averments made therein, including the jail report.

Considering the fact that the applicant was last released on parole leave and had surrendered within time, and further considering that there are no adversarial remarks against the applicant in the jail report, this Court deems it appropriate to exercise its discretion in favour of the applicant.
4. The present application is partly allowed. The applicant is ordered to be released on parole leave for a period of 7 days from the date of his actual release, on executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) before the Jail Authority and subject to such usual terms and conditions as may be imposed by the Jail Authority.
5. The applicant shall surrender before the Jail Authority immediately upon completion of the parole leave, without fail. It is clarified that no further extension of parole leave shall be granted.

6. Rule is made absolute to the aforesaid extent. Registry is directed to communicate this order to the concerned Jail Authority by fax / email message forthwith.
