Rule. Learned APP waives service of notice of rule for respondent - State of Gujarat.

1. By way of the present application, the applicant has sought parole leave on the ground of providing financial assistance to his family and for arranging the school fees of his children.

2. Heard learned advocates appearing for the respective parties. Perused the documents produced along with the application as well as the averments made therein, including the jail report.

Considering the fact that the applicant has been convicted under Section 138 of the Negotiable Instruments Act, 1881, and further considering the jail remarks indicating that the applicant has already undergone more than one year of imprisonment, coupled with the necessity of arranging the educational expenses of his children, this Court deems it appropriate to exercise its discretion in favour of the applicant.

4. The present application is partly allowed. The applicant is ordered to be released on parole leave for a period of 10 days from the date of his actual release, on executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) before the Jail Authority and subject to such usual terms and conditions as may be imposed by the Jail Authority.

5. It is clarified that no further extension of parole leave shall be granted.

6. Rule is made absolute to the aforesaid extent. Registry is directed to communicate this order to the concerned Jail Authority by fax / email message forthwith.
