                                                             ORAL ORDER

1. Rule. Learned APP waives service of notice of rule for respondent - State of Gujarat.

2. By way of the present petition, the petitioner has prayed to release him on parole leave on the ground of filing criminal appeal before this Hon'ble Court. In support of it, necessary documents are produced on record.

3. I have heard learned advocates appearing for the parties and have also perused the documents produced along with the petition as well as considered the averments made in this petition including jail remarks. The jail conduct is found to be good. Considering the fact that the petitioner is recently convicted in Special Pocso Case No.26 of 2025 vide Page 1 of 2 Uploaded by URIL KRISHNAKUMAR RANA(HC01406) on Fri May 22 2026 Downloaded on : Fri May 22 23:57:51 IST 2026 NEUTRAL CITATION R/SCR.A/7215/2026 ORDER DATED: 21/05/2026 undefined Judgment dated 07.05.2026, and all throughout he had remained in jail as undertrial prisoner for more than one year. Therefore considering the grounds mentioned and the averments made in the petition and to unable the petitioner to avail his statutory right to file an appeal, the present petition deserves to be allowed.

4. Therefore, the present petition stands allowed partly. The petitioner prisoner is ordered to be released on parole leave for a period of two weeks from the date of his actual release, on executing personal bond of Rs.5,000/- (Rupees Five Thousand) before the Jail authority and on usual terms and conditions as may be imposed by the Jail Authority.

5. The petitioner shall surrender before Jail Authority on completion of parole leave, without fail.

6. Rule is made absolute to the aforesaid extent. Direct service is permitted. Registry to communicate the present order to the concerned jail authority forthwith.
