ORAL ORDER
1. Rule. Learned APP Mr. Rohan N Shah waives service of notice of rule for respondent - State of Gujarat.
2. By way of the present application, the applicant has prayed to release him on temporary bail on the ground of financial assistance to the family as the applicant is the only bread winner of his family.
3. I have heard learned advocates appearing for the parties and have also perused the documents produced along with the application as well as considered the averments made in this application including jail report. As per the jail report, whenever the applicant was released, he surrendered in time and more particularly, his last released was in the year 2024. Considering the aforesaid and having considered the ground for temporary release i.e. with regard to financial assistance to the family, this Court deems fit to exercise its discretionary power, and therefore, the present application deserves to be allowed.
4. Therefore, the present application stands allowed partly. The applicant is ordered to be released on temporary bail for a period of two weeks from the date of his actual release, on executing personal bond of Rs.5,000/- (Rupees Five Thousand) before the Jail authority and on usual terms and conditions as may be imposed by the Jail Authority.
5. The applicant prisoner shall surrender before Jail Authority on completion of temporary bail, without fail.
6. Rule is made absolute to the aforesaid extent. Direct Service is permitted.
