ORAL ORDER
1. RULE. Learned APP waives service of Rule on behalf of the respondent-State.
2. The present petition is preferred by the applicant to release him on parole leave on account of death of his brother.
3. Learned Advocate appearing for the applicant submitted that brother of the applicant viz. Vikrambhai D. Odedara died on 10.05.2026. Upon instructions, learned Advocate appearing for the applicant submitted that the applicant is agreeable to bear the cost of Police escort in case if he is allowed to be enlarged on Parole Leave and he shall deposit the amount before the concerned Police authority.

5. In view of that, the present petition is hereby partly allowed. The applicant is ordered to be enlarged on Parole Leave for a period of 7 (Seven) days to attend the post-death rituals of his deceased brother on depositing the amount of Police escort, that may be quantified by the Office of the Commissioner of Police, Surat City, from the date of his actual release on usual terms and conditions including furnishing a bail bond of Rs.10,000/- to the satisfaction of the concerned Jail authority. The applicant shall mark presence at nearer Police Station and surrender before the Jail authority on or before the expiry of the period of Parole Leave. Rule is made absolute to the aforesaid extent. Direct service is permitted.
