ORAL ORDER
Rule. Learned APP waives service of notice of rule for respondent - State of Gujarat.
1. By way of the present application, the applicant has prayed to release him on parole leave on the ground that he has never been released on bail since five years. In support of it, necessary documents are produced on record.
2. Considering the fact that the applicant has been in jail for more than five years and during this period has never been released on any kind of bail, and further considering that, upon perusal of the jail remarks, the conduct of the applicant is found to be good with no adverse remarks against him, this Court deems it appropriate to exercise its discretion and allow the present application.
3. The applicant prisoner is ordered to be released on parole leave for a period of 21 days from the date of his actual release, on executing personal bond of Rs.5,000/- (Rupees Five Thousand) before the Jail authority and on usual terms and conditions as may be imposed by the Jail Authority.
4. The applicant shall surrender before Jail Authority on completion of parole leave, without fail.
5. Rule is made absolute to the aforesaid extent. Registry is directed to communicate this order to the concerned Jail Authority by fax / email message forthwith.
