ORAL ORDER
1. This application is preferred by the applicant for temporary bail for a period of 30 days on the ground of providing financial assistance to his family and to remain present for surgery of his wife Afsa Shohel Bhaijamal at GMERS Medical College and Hospital, Godhra District Panchmahals.
2. Heard learned advocate for the applicant and learned APP for the Respondent - State. Learned APP Mr. Soaham Joshi has placed on record the report submitted by the I.O.
3. RULE. Learned APP waives service of notice Rule on behalf of the respondent-State.
4. The applicant is ordered to be released on temporary bail for a period of 07 days from the date of actual release on the applicant furnishing a personal bond of Rs.25,000/- (Rupees Twenty Five Thousand) with one surety of the like amount to the satisfaction of the jail authority and on usual terms and conditions, as may be imposed by the jail authority, and on a condition that the Applicant shall mark his presence daily before the concerned police station.
5. The applicant shall surrender before the concerned jail authority on expiry of the temporary bail period, further the applicant shall submit the medical report of his wife's surgery, once he surrenders before the jail authority.
6. The application is allowed in the aforesaid terms. It is hereby clarified that no further extension shall be granted and further the Court shall not entertain any application for reduction of amount of Bail bond and surety. Rule is made absolute accordingly.
