1. Rule. Learned Additional Public Prosecutor waives service of rule on behalf of respondent - State.

2. The wife of the applicant, who is Party-in-Person is present before this Court, she has urged that the younger son requires surgery of his nose, whereas the elder son has to take admission in college, therefore, the presence of the applicant is required for providing financial assistance as well as to look after the medical needs of their son. 3. In view of the facts and the submissions made, this application is partly allowed.

4. Therefore, the present application stands allowed partly.

The under-trial prisoner is ordered to be released on temporary bail for a period of 21 days from the date of his actual release, on executing personal bond of Rs. 25,000/- (Rupees Twenty Five Thousand) before the Jail authority and on usual terms and conditions as may be imposed by the Jail Authority.

5. The under trial prisoner to mark his presence before the concerned Police Station every alternate day during his temporary release period. The under-trial prisoner shall surrender before Jail Authority on completion of temporary bail, without fail.

6.
