ORDER
1. The present application has been preferred by the applicant to release him on temporary bail for a period of 30 days on the ground of his wife's medical ailment.
2. The applicant is facing trial under the provisions of the NDPS Act. Earlier vide order dated 06.05.2026, the applicant was released on temporary bail for 3 days on the ground of providing financial assistance and had to surrender on 09.05.2026. Thereafter, on 08.05.2026, temporary bail granted to the applicant has been extended till 11.05.2026 on the ground of applicant's wife's operation. However, since the extension was sought for on his wife's operation, learned APP was directed to verify the cause. Pursuant to the same, police has recorded the statement of Dr.Sudhir Maghesiya (MS, Consultant General and Leproscopic Surgeon), wherein he has clearly stated the patient had come to his hospital with stomach pain and he advised for Sonography and upon showing his report, he advised for operation but thereafter, he never visited his hospital. Further, he has stated that he has not issued any certificate. Report submitted by the police is ordered to be taken on record.

3. Considering the aforesaid facts, it appears that the applicant in any how attempted either to extend his temporary bail or to come out from the jail on one pretext or another. However, considering the fact that the applicant is facing serious charges under the NDPS Act and that the quantity of MD drugs seized from him is of commercial quantity, this Court is not inclined to extend the temporary bail. Therefore, learned counsel for the applicant does not press the present application. However, the applicant shall deposit costs of Rs. 5,000/- with the Gujarat High Court Legal Services Authority within one week.
Application stands disposed of as not pressed.
