ORDER
1. RULE. Learned APP waives service of rule for the respondent-State.
2. The present application has been preferred by the applicant who is under-trial prisoner to release him on temporary bail on the sad demise of his father, who has expired on 11.05.2026 due to cardiac arrest and septicemia. The applicant is the accused of FIR being C.R.No.11191024250315 of 2025 registered at Ramol Police Station, Ahmedabad City, for the offence under Sections 109(1), 118(1), 189(2), 189(4), 190, 191(2), 191(3), 126(2), 324(6), 296(b) and 351(3) of BNS and section 135(1) of GP Act.
3. Learned APP draws attention of this Court to the jail report to indicate that the jail conduct of the applicant is reported to be good and earlier when he was released from jail, he reported in time.
4. Taking into consideration the ground urged in this application, application is partly allowed. The applicant is ordered to be released on temporary bail today i.e. 12.05.2026 till completion of cremation rituals with police Japta at the cost of State exchequer. The applicant shall surrender today evening upon completion of cremation of his father. Rule is made absolute accordingly. Registry is directed to send copy of this order to the concerned jail authority through fax.
