                                                            Date : 11/05/2026

                                                         ORDER

1. RULE. Learned APP waives service of Rule on behalf of the respondent-State.

2. The present petition is preferred by the petitioner through his wife to release her husband on parole for 30 days as her hut is demolished due to encroachment and she along with her children are living on the footpath and therefore, to arrange the hut and other things, presence of petitioner is required.

3. Learned APP draws attention of this Court to the jail report to indicate that the petitioner has chequered history stating that when he was released on temporary bail in the year 2016-17, he remained absconder for 366 days. Further when he was released on parole in the year 2018, again he remained absconder for 2574 days and apprehended by the police. His jail conduct is also not good. One complaint under Section 51(1) of the Prisons Act has also been registered at Ranip Police Station on 30.06.2018.

4. In that view of the matter, no case is made out to entertain present petition. Hence, dismissed.
