                                                           ORAL ORDER

1. Heard learned advocate Mr. K.K. Desai appearing for the applicant and learned APP Mr. Hardik Mehta for the respondent no.1 - State.

2. Rule. Learned APP waives service of Rule on behalf of the respondent State.

By way of this application, the applicant seeks for modification of condition no. three of order dated Page 1 of 4 Uploaded by MS.PARUL DUTTA(HCD0073) on Wed Apr 08 2026 Downloaded on : Wed Apr 08 22:46:30 IST 2026 NEUTRAL CITATION R/CR.MA/7476/2026 ORDER DATED: 08/04/2026 undefined 23.01.2024 passed by learned Sessions Court in Criminal Misc. Application No. 74 of 2024, whereby the applicant has been directed to deposit his passport and not to leave India without prior permission of the learned Sessions Court.

Considering the submissions made by learned advocate Mr. Desai and having perused the documents on record, it would prima facie appear that while the order has been passed in the year, 2024, the trial, is still at a nascent stage and whereas, it does not appear that absence of the present applicant for a brief period may adversely impact the trial. It would also appear that the applicant has produced documents to show that the applicant intends to travel from 10.04.2026 to 30.05.2026 for business purpose to China. This Court has also noted the contention of learned advocate that the applicant would be ready and willing to deposit an amount of Rs. 5,00,000/- with the learned Trial Court, which amount shall stand as a surety Page 2 of 4 Uploaded by MS.PARUL DUTTA(HCD0073) on Wed Apr 08 2026 Downloaded on : Wed Apr 08 22:46:30 IST 2026 NEUTRAL CITATION R/CR.MA/7476/2026 ORDER DATED: 08/04/2026 undefined for the applicant to return back in time.

5. Having regard to the above considerations, the following directions are passed:

5.1. The applicant to deposit an amount of Rs. 5,00,000/-

with learned Trial Court and upon such amount being deposited, the learned Trial Court shall release passport of the applicant in his favour.

5.2. Condition no.3, in order dated 23.01.2024 passed in Criminal Misc. Application No. 74 of 2024 , is directed to be kept in abeyance from 10.04.2026 to 06.06.2026. 5.3. The applicant is permitted to travel to China as per travel documents and itinerary annexed with this application.

5.4. The applicant shall return back in time and whereas, the passport shall be deposited with learned Trial Court by 06.06.2026.

5.6. In case the applicant violates any of these conditions, the learned Sessions Court may take steps in accordance with law, in case any condition is violated the learned Trial Court is also at liberty to appropriate the amount of Rs. 5,00,000/-.

6. With these observations and directions, the application stands disposed of as allowed. Rule is made absolute to the aforesaid extent.
