ORAL ORDER
(PER : HONOURABLE MS. JUSTICE SANGEETA K. VISHEN) By this application, the applicant has prayed for condoning the delay of 83 days caused in preferring the captioned First Appeal.
2. Mr Baiju Joshi, learned advocate for the applicant states that immediately after the judgment was rendered, certified copy was applied for. As the applicant was desirous of having the custody of his daughter, however, in getting copies, meeting lawyer, providing information, time got consumed and in the process, there occurred a delay of 83 days. It is submitted that the delay is bona fide and same be condoned.

Having regard to the averments, so also the submissions made, this Court is of the considered opinion that the delay has been sufficiently explained and deserves to be condoned and is hereby, condoned. Civil Application succeeds and is accordingly, allowed. Rule is made absolute. No order as to costs.
