ORAL ORDER
1. Heard learned counsel for the applicant.
2. The present application has been preferred for seeking condonation of delay of 51 days caused in preferring the appeal against the impugned judgment and award dated 12.12.2024 passed by the learned Motor Accident Claims Tribunal (Special), Chhotaudepur at Bodeli in M.A.C.P. No. 104 of 2021.
3. Mr. Aayush Bhandari, learned advocate for the applicant- Insurance Company submitted that the delay of 51 days has occasioned in preferring the appeal owing to administrative reasons, as reasonable time was consumed in transmitting the necessary records of the case along with certified copy of the impugned order from the branch office of Page 1 of 2 Uploaded by MR.HARSHIT SANCHETI (HCD0070) on Mon Oct 06 2025 Downloaded on : Mon Oct 06 21:57:59 IST 2025 NEUTRAL CITATION C/CA/3889/2025 ORDER DATED: 29/09/2025 undefined the Insurance Company to its head office and thereafter for seeking instructions for preferring the appeal. He further submitted that the delay is neither intentional nor malafide, but has occasioned owing to the reasons mentioned in detail at para no. 2 of the instant application.
4. The notices have been duly served upon the contesting respondents, but they have chosen not to appear before this Court.
5. Having considered the submissions of the learned counsel for the applicant and having regard to the ground pressed into service, in my considered view, constitutes a sufficient cause to condone the delay. Accordingly, the delay in preferring the appeal against the impugned judgment and award is hereby condoned.
6. In view of the above, the present Civil Application stands disposed of. No order as to costs.
